Pollution control: Construction


The council monitors construction work to minimise pollution caused by noise, dust and other nuisances.

The Control of Pollution Act 1974

The Act gives local authorities the power to impose requirements on how construction works are carried out. If found guilty of an offence under this Act, offenders can be fined of up to  £5,000, with a maximum penalty of £50 for each day the offence continues after conviction.

The Council would expect noisy building works to be carried out between:

  • Monday-Friday 8am-6pm
  • Saturday 8am-1pm

and not on Sundays and bank Holidays.


There are a number of legislative controls and steps to follow for noise on a construction site and all sub-contractors and specialist contractors should be aware of these requirements.


Best practice guidance includes

  • British Standard 5228-1: 'Code of practice for noise and vibration control on construction and open sites'.

Companies intending to carry out extended work may apply in advance for permission for the methods by which these works are to be carried out or to extend the hours of work.
