Planning and building control

Article 4 directions are designations a local authority can introduce to remove permitted development rights.

This means you'll need planning permission for developments (or changes of use) that wouldn’t normally be required under national planning policy.

We have made an Article 4 direction on 21 November 2016 to remove permitted development rights related to development comprising change of use from a use falling within light industrial (B1c) to dwelling houses (C3). Planning permission will therefore be required for the change of use from Class B1c to Class C3 once the Article 4 direction is in force. 

The Article 4 direction applies to the whole borough.

A copy of the direction, including a map defining the area covered, can be viewed during normal office hours at The Magistrates, 1 Farnan Avenue, Walthamstow, London E17 4NX.

We have made an Article 4(1) direction on 9 June 2017, under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015, as amended. The Article 4 direction has been confirmed by us on 17 January 2018. The Article 4 direction applies to the whole borough and comes into force on 24 July 2018.

This means that planning permission will be required for the change of use of a retail shop (use class A1) to any of the following uses: financial and professional services (A2); restaurants (A3), dwelling houses (C3) or assembly and leisure (D2).

Background information 

We have made an Article 4(1) direction on 14 July 2017, under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015, as amended (“the Order”).

The direction applied to the whole borough and related to development comprising change of use from a use falling within Class B1(a) (offices) of the Order to a use falling within Class C3 (dwelling houses) of the Order, and sought to remove permitted development rights for this type of development.

On 9 February 2018, a decision was made to vary the order so that it would only apply to Walthamstow town centre, designated employment areas and district and neighbourhood centres (rather than borough wide), so that planning permission will be required for changes of use from Class B1(a) to Class C3 within these areas once the Article 4 direction is in force.

The Council invited representations on the variation to the Article 4 Direction between 5 March 2018 and 2 April 2018. This document gives notice in accordance with Schedule 3 that the varied Article 4 Direction has been confirmed by the Council on 4 June 2018. The varied Article 4 Direction shall come into force on 24 July 2018.

Background information

For planning purposes, a house in multiple occupation (HMO) is a small shared dwelling house or flat occupied as the main residence of between three and six unrelated individuals who share basic amenities.

They fall within Use Class C4 of the government's Use Class Order.

Under national planning policy, a change of use from a dwelling house (Use Class C3) to a HMO (Use Class C4) is normally permitted development.

However, we have introduced an Article 4 direction throughout the borough, meaning you’ll need planning permission for this change of use.

Article 4 directions also apply to conservation areas.

These areas have special architectural or historic interest. Their character or appearance are considered necessary to preserving or enhancing an area.

In these areas, planning permission will be required for the following works:

  • enlargement, improvement or other alteration of a dwelling house such as changes to windows, doors, roof coverings, chimneys and rainwater goods
  • alterations to roofs that materially affect the shape of a dwelling house
  • building of a front porch
  • provision of a hard standing
  • installation, alteration or replacement of a satellite antenna
  • building, altering or removing of a chimney on a dwelling house or on a building within the curtilage
  • building, altering or demolition of a front gate, fence, wall or other means of enclosure within the front garden, or a side boundary facing the road
  • painting of a dwelling house (apart from like-for-like repainting)
