Penalty Charge Notices issued in Waltham Forest have a charge of either £120, £100 or £60 dependent on the contravention (what they were issued for), these charges are discounted by 50% to £60, £50 or £30 respectively - if paid within 14 days of the penalty being issued.

Representation against a parking ticket

You can write to the Council about a penalty notice after a Notice to Owner is received.  The address to contact is on the Notice to Owner. A Notice to Owner is sent to the person who appears to be the owner of the vehicle 4 to 5 weeks after the contravention if the penalty is not paid.  The Notice to Owner will tell you how to make a formal representation against the penalty notice.

Please note - The owner of the vehicle is normally liable not the driver

If the London Borough of Waltham Forest do not cancel your penalty ticket, or if you want to make a representation for any reason other than the parking attendant making a mistake, you can make a representation later on to the Council. Four or five weeks after the ticket is issued, a Notice to Owner document will be sent to the registered vehicle keeper. On the back of the Notice is an representation form which you can send to the Council. You cannot make a formal representation to the Council before you get the Notice to Owner. At this stage the full penalty will apply if the Council does not cancel the ticket.

If you want to make representation to the Council at this stage you must have strong grounds for that representation. You cannot make a representation, for example, for any of the following reasons:

  • If you disagree with the parking regulations
  • If you only parked illegally for a few minutes
  • If you think that you were not blocking the road or footpath
  • If there was nowhere else to park
  • If you forgot to display your parking permit clearly enough
  • Mitigating circumstances will be considered, please include any available supporting evidence

If the Council cannot cancel your penalty, we will write and tell you why your representation has been rejected. With that letter we enclose another form on which you can make a final representation to the Parking and Traffic Appeals Service (external). This is an independent Representation Tribunal and their decision is final and binding on both parties.
