A vehicle is deemed to have been abandoned if it has been left on land in the open air, or on any other land forming part of a highway, unwanted and discarded by its owner or others for a significant period.

When forming an opinion as to whether the vehicle is abandoned, the Council will take into consideration the taxation status, condition of the vehicle, length of time at location and any other relevant information that is available.

Taxed vehicles are not generally considered as abandoned unless there are extenuating circumstances (significant health and safety issues).

Untaxed vehicles

Under the Vehicle Excise Legislation, the Council will remove any untaxed vehicle on a road maintained at public expense, if the necessary authorisation is given.

Abandoned vehicles cannot be dealt with under this legislation.
