The Council aims to clear dumped rubbish from public land within 24 hours of it being reported to us, through the on-line reporting form or Waltham Forest Direct on 020 8496 3000. We will take enforcement action against the offender where possible.
On private land it is the responsibility of the owner or occupier of the land to have fly tipping cleared. The Council can serve legal notice on the owner or occupier to ensure that this occurs.
Your legal duties
Residents have a duty of care to ensure that any waste produced by them is disposed of legally, in accordance with Section 34 of the Environmental Protection Act 1980. This may be by way of a waste receptacle (bin), skip or other authorised waste disposal collector.
Failure to ensure that waste is correctly disposed of can lead to prosecution for an offence under Section 34 (maximum fine £5,000) or Section 33 Flytipping (maximum fine £50,000 and up to 5 years imprisonment)
It is your responsibility to ensure that any waste you have is disposed of lawfully and you must ensure that any private company that you employ to dispose of waste is an authorised waste carrier. You can do this by asking them for their Environment Agency Registration number which you can check online or by calling 08708 506506.
The unauthorised placing or disposing of trade waste under the above circumstances is covered under section 34 of the Environmental Protection Act 1990 for which there is an unlimited fine and possible imprisonment. Find out more about the Trade Waste duty of care.
